1. Acceptance of Terms

• No prior bans: You must not have been previously suspended, banned, or removed from the Platform for violations of these Terms.

3. User Conduct & Prohibited Behavior

3.1 Expected Conduct

• Treat other members with dignity, courtesy, and respect in all communications
• Use the Platform solely for its intended purpose of building legitimate personal relationships
• Report any suspicious behavior, scam attempts, or policy violations to our support team promptly
• Keep login credentials secure and not share account access with any third party

3.2 Prohibited Activities

The following activities are strictly prohibited on the Platform. Violations may result in immediate account suspension or permanent termination:

1. Creating fake, misleading, or impersonation profiles
2. Harassing, threatening, intimidating, or stalking other users
3. Sending unsolicited commercial messages, spam, or promotional content
4. Soliciting money, financial information, or gifts from other members
5. Uploading content that is obscene, illegal, defamatory, or violates the rights of others
6. Attempting to collect personal data from other users through deceptive means
7. Using automated bots, scrapers, or software to access or interact with the Platform
8. Circumventing security measures, access controls, or anti-fraud systems
9. Engaging in any form of human trafficking, exploitation, or illegal activity
10. Creating multiple accounts to evade bans, restrictions, or usage limitations

4. Account Registration & Security

When you create an account on the Platform, you are responsible for maintaining the confidentiality and security of your login credentials. You agree to the following obligations:

• Provide a valid email address that you actively monitor for account-related communications
• Choose a strong, unique password and update it periodically

We reserve the right to require identity verification at any time to maintain the integrity of the Platform. Accounts that fail verification or are found to contain materially false information may be suspended or permanently removed. 5. Intellectual Property

All content, features, design elements, graphics, logos, trademarks, and technology on the Platform are the exclusive property of Balkan Women Dating or its licensors and are protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or publicly display any Platform content without our prior written consent.

By uploading photos, text, or other content to your profile, you grant Balkan Women Dating a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely in connection with operating and promoting the Platform. You retain ownership of your original content and may remove it at any time by deleting it from your profile or deactivating your account. This license terminates when you delete the content or close your account, except where your content has been shared with other users and they have not deleted it.

6. Limitation of Liability

Balkan Women Dating serves as a platform to facilitate introductions and communication between users. We do not guarantee the accuracy of user-provided information, the behavior of any member, or the outcome of any interaction or relationship formed through the Platform.

To the fullest extent permitted by applicable law, Balkan Women Dating, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: emotional distress, loss of data, financial losses, or damages resulting from interactions with other users. Our total aggregate liability for any claim related to these Terms or the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Platform is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.

7. Dispute Resolution

In the event of a dispute arising from or relating to these Terms or your use of the Platform, both parties agree to the following resolution process:

1. Informal Resolution: You agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will make good-faith efforts to resolve the matter within 30 days.
2. Mediation: If informal resolution fails, both parties agree to participate in non-binding mediation administered by a mutually agreed mediator before pursuing arbitration or litigation.
3. Binding Arbitration: If mediation is unsuccessful, any unresolved dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in San Francisco, California, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Class Action Waiver: You agree that disputes will be resolved on an individual basis only. You waive the right to participate in a class action, class-wide arbitration, or any consolidated proceeding.

8. Termination Policy

We reserve the right to suspend or terminate your account at our sole discretion, with or without prior notice, under the following circumstances:

• Violation of any provision of these Terms or our community guidelines
• Engaging in fraudulent, deceptive, or illegal activity on or through the Platform
• Receiving multiple complaints or reports from other users
• Failure to respond to identity verification requests within the specified timeframe
• Extended account inactivity exceeding 24 months
• Any conduct that we reasonably determine to be harmful to the Platform, its users, or its reputation

You may deactivate or delete your account at any time through your account settings or by contacting our support team. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination - including intellectual property rights, limitation of liability, dispute resolution, and governing law - shall remain in effect.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California and the federal laws of the United States, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco County, California. By using the Platform, you consent to the personal jurisdiction and venue of these courts.
